In this context, reisetopia GmbH offers membership with the right to use the premium services of suitespot as well as the use of all regular services of suitespot as well as access to all content created on the websites of reisetopia GmbH.
a) By entering the payment information and completing the transaction via the service providers chargebee & Adyen, a legally binding contract is created between reisetopia GmbH and the customer. This automatically comes into effect when you send the email confirming your membership. The contract is concluded in German.
b) The customer must immediately notify any relevant changes to contract-relevant data (name, address, changed payment details, etc.).
a) The concluded contract is valid for 365 days from the day the contract is concluded and is automatically extended for a further twelve months unless it is terminated at least 30 days before the end of the contract.
b) The initial conclusion of the contract is accompanied by a membership term of 365 days, which is calculated on a rolling basis. This means that the contract is always valid for 365 days from the day the contract is concluded and can therefore also be concluded or expire during the year.
c) The contract can be terminated without giving a reason 30 days before the day that is 365 days after the initial membership or the last extension.
a) Membership gives you the right to use the premium services of suitespot. These include, among other things, the possibility of booking a large part of the hotels from the portfolio online and therefore independently, as well as the possibility of viewing and comparing the individual advantages in a large part of the suitespot after logging in.
b) Membership gives you the right to use all regular services from suitespot. These include, among other things, a premium service, the management of bookings, loyalty numbers and payment information in the customer account.
c) Membership gives you the right to use all regular suitespot services as well as access to all content created on the reisetopia GmbH websites.
d) The regular services as well as the premium services of suitespot can be changed, shortened or expanded at any time.
e) Since reisetopia GmbH only acts as an agent, membership does not give rise to any claims against contractual partners of reisetopia GmbH and explicitly not against hotels or financial service providers.
a) Payment for the membership is made before activation on the day the test period expires using a payment method of the customer's choice specified on the website of the third-party providers Chargebee and Adyen on the day the membership is completed. When choosing the payment methods offered, reisetopia GmbH reserves the right to make changes at any time.
b) If the membership is automatically extended, the initially specified payment method will be charged again unless the membership is canceled in due time.
c) If the specified means of payment cannot be debited in the event of an extension without termination, the customer must independently specify a new means of payment and settle the claim within 30 days. Otherwise, the right to use all membership services expires.
d) A refund of amounts already paid can only take place with an undisputed or legally established claim, with claims for damages and reimbursement of expenses due to serious defects, if this intention is reported in text form before the end of a membership year.
a) reisetopia GmbH offers a free trial period of 90 days when you take out a membership for the first time. The reference date is the 90th day after the membership was completed.
b) The deposited payment method will not be debited during the test period. This will only be charged after the test period has expired when the membership is automatically converted into a regular membership.
c) No reasons are required for termination within the test period.
d) The test period only applies when the membership is initially completed and not when a membership is extended.
e) Bookings that have already been made and whose stay dates are after the end of the test period will remain valid, but can only be changed within the scope of the regular scope of services. The promised benefits of the corresponding bookings remain intact.
a) You have a right of withdrawal in accordance with the statutory provisions.
b) You have the right to cancel the contract within fourteen days without giving reasons. The revocation can be made via a written notification to reisetopia GmbH or alternatively by independently canceling the membership via the third-party provider Chargebee.
c) The cancellation period is fourteen days from the day the membership is completed and the test period begins.
d) In order to exercise the right of withdrawal, reisetopia GmbH, Dessauer Str. 28-29, 10963 Berlin, must be informed of the decision to withdraw from this contract by means of a clear statement.
e) In order to meet the cancellation period, it is sufficient that the notification of the exercise of the right of cancellation is sent before the cancellation period has expired.
f) If the contract is revoked, all payments received by reisetopia GmbH will be repaid immediately and no later than fourteen days from the day on which notification of the revocation of this contract was received. The same payment method that was used for the original transaction will be used for this repayment; In no case will any fees be charged as a result of this repayment.
a) Membership can be terminated at any time during the contract term without giving reasons. If the cancellation occurs more than 90 days after the initial membership was concluded, there will be no pro rata refund of the annual membership amount already paid.
b) If you cancel within one membership year after the end of the money-back guarantee period, the premium membership will remain valid until the date that is 365 days after the day the contract was initially concluded. All benefits of the premium membership can continue to be used during this period.
c) If termination occurs at least 30 days before the end of a contract year, membership will not be automatically extended.
d) If termination occurs less than 30 days before the end of a contract year, it will only become valid 12 months later. In this case, there is still an obligation to pay the membership fee for the following year. All benefits of the premium membership remain until the membership ends.
e) Bookings that have already been made and whose stay dates are after the date of termination of a membership remain valid, but can only be changed within the scope of the regular scope of services. The promised benefits of the corresponding bookings remain intact.
f) In the event of termination, the account will not be deleted. This will instead be downgraded to a basic account. If the premium membership is reactivated later, the premium benefits will apply again and all historical data will be retained.
a) Subject to the following regulations, reisetopia GmbH is only liable in the event of intent, gross negligence or culpable violation of essential contractual obligations. Essential contractual obligations are those obligations that make it possible to achieve the purpose of the contract and on whose compliance the member regularly trusts and may rely. In the event of a breach of essential contractual obligations due to slight negligence, our liability is limited to the foreseeable damage that is typical for the contract.
b) The liability of reisetopia GmbH exclusively covers the intermediary activity and the scope of services mentioned above. reisetopia GmbH assumes no liability for services provided by contractual partners, such as hotels or financial service providers.
a) Membership with reisetopia GmbH is tied to the name and email address of the account holder. After manual checking, a change of email address is possible; a change of name is only possible in the event of marriage, divorce or another important reason for changing the last name, including appropriate proof.
b) Transferring membership to another person is not possible during the contract term. However, when booking suitespot, reisetopia GmbH expressly allows bookings for third parties. In this case, all booking benefits also apply to the beneficiary. Only benefits associated with account log-in cannot be transferred.
a) reisetopia GmbH reserves the right to change these General Terms and Conditions with effect for the future, with the exception of the essential contractual obligations, if this is necessary due to laws and changes in case law or other significant changes to the underlying framework conditions. Any changes to this will be made at least six weeks in advance by email. The change is deemed to have been accepted if the member does not object in text form by the time it comes into force. We will expressly inform the member of this legal consequence when notifying them of the change.
b) Excluded from the obligation to inform about changes is a changed scope of services of the premium or a regular membership with suitespot.
As part of this contract and our customers, as the person responsible for data protection within the meaning of Article 4 No. 7 of the EU General Data Protection Regulation (GDPR), we process the customers' personal data required to initiate, implement and terminate the contract. We process all of customers' personal data exclusively in accordance with the applicable data protection laws, in particular in compliance with the requirements of the GDPR. a) The law of the Federal Republic of Germany applies to these General Terms and Conditions of Sale and the contractual relationship between reisetopia GmbH as the provider and the buyer, excluding international uniform law, in particular the UN Convention on Contracts for the International Sale of Goods.
b) The place of jurisdiction for all disputes arising from the contractual relationship between the customer and the provider is the registered office of the provider, reisetopia GmbH, in Berlin, provided that the customer is a merchant, a legal entity under public law or a special fund under public law acts.
If a provision of these General Terms and Conditions is ineffective, the validity of the remaining provisions will not be affected.
