Membership terms suitespot Premium

Translation – the German version prevails.

Last updated: 20 October 2026

§ 1 Provider and scope

(1) The provider of the “suitespot Premium” membership is reisetopia GmbH, Dessauer Straße 28–29, 10963 Berlin, Amtsgericht Charlottenburg (Local Court) HRB 210880, VAT ID DE311975567, Managing Director: Moritz Lindner, email: hotel@suitespot.com, phone: +49 30 75438770, WhatsApp: +49 30 81452346 (“suitespot”, “we”).

(2) These terms apply to the paid suitespot Premium membership (“membership”). For the free suitespot account and the intermediation of hotel bookings, our General terms of intermediation (GTI) also apply, and for gift vouchers our voucher terms. Where the membership is concerned, these terms take precedence.

(3) The membership is intended for consumers who use suitespot for private travel (§ 9). Any differing terms of the member do not apply.

§ 2 Membership services

(1) The membership includes all services of the free suitespot account (§ 3 GTI) and, in addition:

  1. Online booking: You can book hotels from the suitespot portfolio for which online booking is offered online yourself, with current prices and availability.
  2. Benefits already in the search: You can see the benefits a hotel grants via suitespot (e.g. breakfast, hotel credit, upgrade subject to availability) already in the hotel search and compare hotels on that basis.
  3. Priority service: We handle your requests to our team with priority.

(2) The benefits during a stay are granted by the respective hotel on the basis of our agreements with the hotel or hotel group. The benefits stated in your booking confirmation are decisive. Benefits marked “subject to availability” (e.g. upgrade, early check-in, late check-out) are allocated by the hotel on arrival; there is no entitlement to them. Benefits without this reservation are covered by our benefit guarantee: if the hotel does not grant such a benefit, we will refund you the equivalent value (§ 4(4) GTI). Details on booking and benefits are set out in the GTI.

(3) The hotel portfolio and the benefits of individual hotels change continuously, for example because hotels are added, change programmes or end the cooperation. The membership does not entitle you to any particular hotel or any particular benefit remaining available permanently. § 5(8) applies to bookings that have already been confirmed.

(4) We may change the services under paragraph (1) if there is a valid reason for doing so (e.g. changed legal requirements, technical development, changes at our partners), the core services under paragraph (1) nos. 1 and 2 are retained and the change is reasonable for you. If we materially restrict the services, we will notify you of this in text form (e.g. email) at least six weeks in advance. You may then cancel the membership without notice until the change takes effect and will receive a pro rata refund of the fee paid in advance for the period thereafter. Extensions and improvements are possible at any time.

§ 3 Conclusion of the contract

(1) A suitespot account is required for the membership. You must be of legal age.

(2) In the ordering process, you select the membership, enter your details and a means of payment, and complete the order using the button “Subscribe and pay” (or an equivalent label). By doing so, you submit a binding offer. The contract is concluded when we activate the membership, at the latest with our confirmation email. Payments are processed by our service providers Chargebee and Adyen.

(3) After the contract has been concluded, you will receive a confirmation by email containing these terms and the instructions on withdrawal.

(4) These terms are available in German, English, French and Spanish. The contract is concluded in the language in which you place your order. In the event of discrepancies, the German version prevails unless mandatory consumer protection provisions provide otherwise.

(5) Please keep your details (name, email address, means of payment) in your account up to date.

§ 4 Trial period

(1) When you take out a membership for the first time, you can try Premium free of charge for 90 days (“trial period”). The trial period is available only once per person. We may change the length of the trial period for future sign-ups; the length shown in the ordering process applies.

(2) You pay nothing during the trial period. Your means of payment will only be charged after the trial period has ended, and only if you have not cancelled beforehand.

(3) You can cancel at any time during the trial period, up to and including its last day, without giving reasons and free of charge. Premium then remains available to you until the end of the trial period.

(4) We will remind you by email no later than seven days before the end of the trial period of when and in what amount your means of payment will be charged.

§ 5 Term and cancellation

(1) Initial term. The membership begins when the contract is concluded. The initial term comprises the trial period and the twelve months that follow it. If the first membership year is free of charge thanks to a gift, invitation or promotional code (§ 8), the initial term comprises the free year; whether it is preceded by a trial period is shown in the ordering process. For gift codes from the suitespot gift card shop, there is no trial period and the free year begins when the contract is concluded.

(2) Cancellation during the initial term. You can cancel at any time. If you cancel during the trial period, the cancellation takes effect at the end of the trial period; otherwise it takes effect at the end of the initial term. You do not have to observe a notice period; cancelling on the last day is sufficient. Premium remains available to you until the end. There is no pro rata refund for the initial term; your right of withdrawal (§ 7) remains unaffected.

(3) After the initial term. If you do not cancel, the membership continues for an indefinite period after the initial term. The fee is charged twelve months in advance in each case (“billing year”).

(4) Cancel at any time with one month’s notice. After the initial term, you can cancel at any time with one month’s notice. We will refund the fee paid in advance for the period after the end of the contract, calculated pro rata to the day, within 14 days to the original means of payment. Alternatively, you can also cancel with effect from the end of the current billing year.

(5) How to cancel. The easiest way is via the button “Cancel contracts here” in your account. You can also cancel by email to hotel@suitespot.com or by letter. We will confirm every cancellation promptly in text form, stating the date on which it takes effect.

(6) Termination by us. We may terminate the membership with two months’ notice, at the earliest with effect from the end of the initial term. We will refund pro rata any fees paid in advance for the period thereafter.

(7) Termination for good cause. The right of both parties to terminate without notice for good cause remains unaffected. For us, good cause exists in particular in the event of commercial use or transfer contrary to § 9, misuse of the account, or if you remain in default with payment of the fee despite a reminder and a deadline (§ 6(3)).

(8) After the membership ends. Your account will not be deleted but will continue as a free Basic account; your data will be retained. Bookings that have already been confirmed remain in place, as do the benefits committed in them. Changes to these bookings are then possible within the scope of the Basic account. You can take out a new membership again at any time later, without a new trial period.

§ 6 Fee and payment

(1) The annual fee is shown in the ordering process; it is currently EUR 99, CHF 99 or GBP 99, depending on the currency selected. All prices are final prices including statutory VAT.

(2) The fee for the first billing year is due at the end of the trial period or, in the case of a free first year (§ 8), at the end of that year. Thereafter, the fee is due at the beginning of each billing year. We charge the means of payment on file. You will receive the invoice by email.

(3) If the fee cannot be collected, we will inform you by email. You then have 14 days to provide a valid means of payment or to transfer the amount. Until payment is received, we may suspend the Premium services. If you still do not pay after a further reminder with a new deadline of 14 days, we may terminate the membership under § 5(7). You will only bear the costs of a returned payment if you are responsible for it, and only in the amount actually incurred.

(4) Fee changes. For the period after the initial term, we may offer you a changed annual fee, effective from the next billing year. We will notify you of this at least six weeks in advance in text form. An increase only applies if you expressly agree to it, for example by clicking in your account or by email. If you do not agree, the membership continues at the previous fee; we may then terminate it under § 5(6). A reduction applies without your consent.

(5) You may only set off claims that are undisputed or have been finally established by a court, or that arise from the same contractual relationship.

§ 7 Right of withdrawal

As a consumer, you have a statutory right of withdrawal. Details are set out in the following instructions on withdrawal.

Instructions on withdrawal

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (reisetopia GmbH, Dessauer Straße 28–29, 10963 Berlin, telephone +49 30 75438770, e-mail hotel@suitespot.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory. You can also withdraw from the contract via the button “Cancel contracts here” in your account.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.

End of the instructions on withdrawal

Note (not part of the instructions on withdrawal): No compensation is owed during the free trial period because no fee is payable. The last paragraph only becomes relevant if a fee is paid immediately without a trial period (e.g. a repeat membership).

§ 8 Gift, invitation and promotional codes

(1) A gift, invitation or promotional code may waive the fee for the first membership year in full or in part. The terms of the respective code (e.g. our voucher terms) also apply.

(2) A code can only be redeemed when taking out a new membership and only once per account, not for an existing membership. Codes are not paid out in cash.

(3) If the first year is free, you can cancel at any time until the end of that year without incurring any costs (§ 5(2)). If you do not cancel, the membership then continues at the regular fee in accordance with § 5(3) and (4).

§ 9 Personal and private use

(1) The membership is tied to you personally and to your account and is not transferable. A change of email address is possible after verification; a change of name is possible on proof of good reason (e.g. marriage).

(2) You may also book via suitespot for other people, such as family, friends or travel companions. The benefits of the booking then apply to the guest. Features tied to your account remain with you.

(3) The membership is intended for private purposes only. In particular, it is not permitted to use the membership, rates, benefits or other services commercially, to make them available to travel agencies, travel intermediaries or comparable providers, or to resell or re-broker bookings. Bookings for individual people from your personal circle remain permitted.

(4) In the event of a breach of paragraph (3), we may terminate the membership under § 5(7). Further claims remain unaffected.

§ 10 Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz) and to the extent of any guarantee we have given.

(2) In cases of slight negligence, we are only liable for breach of an essential contractual obligation, i.e. an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. In this case, liability is limited to the foreseeable damage typical for this type of contract.

(3) The hotels provide the hotel services on their own responsibility on the basis of the contract you conclude with the hotel. Our obligations as an intermediary and our benefit guarantee are set out in the GTI.

§ 11 Changes to these terms

(1) We may change these terms with effect for the future if this is necessary due to a change in the law or in case law, to close a gap in the provisions that has arisen subsequently, or due to the introduction of new features that are free of charge for you, and the change is reasonable for you. Changes to the services and the fee are governed exclusively by § 2(4) and § 6(4).

(2) We will notify you of changes in text form at least six weeks before they take effect. You may object to the change until it takes effect, or cancel the membership without notice until then. If you object, the previous terms continue to apply; we may then terminate the membership under § 5(6). We will point out these consequences to you in the notification.

§ 12 Data protection

We process your personal data for the performance of the membership in accordance with our privacy policy: https://suitespot.com/privacy-policy

§ 13 Customer service and dispute resolution

(1) Please send questions and complaints to hotel@suitespot.com, by phone to +49 30 75438770 or via WhatsApp to +49 30 81452346.

(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 14 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with your habitual residence in another country, the protection afforded by the mandatory provisions of that country remains unaffected.

(2) If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the place of jurisdiction is Berlin.

(3) Should any provision of these terms be invalid, the remaining provisions shall remain valid.
