General terms of intermediation
Translation – the German version prevails.

§ 1 Provider and scope
(1) suitespot is a service of reisetopia GmbH, Dessauer Straße 28–29, 10963 Berlin, Amtsgericht Charlottenburg (Local Court) HRB 210880, VAT ID DE311975567, Managing Director: Moritz Lindner, email: hotel@suitespot.com, phone: +49 30 75438770, WhatsApp: +49 30 81452346 (“suitespot”, “we”).
(2) These terms apply to the use of our websites, in particular suitespot.com, suitespot.fr and suitespot.es, and the suitespot app, to the suitespot account and to the intermediation of hotel bookings by suitespot. For the paid suitespot Premium membership, the membership terms also apply, and for gift vouchers the voucher terms.
(3) Any differing terms of users do not apply.
§ 2 Our role: intermediary, not hotel
(1) suitespot acts as an intermediary for hotel stays. You conclude the contract for the stay (“accommodation contract”) directly with the hotel or its operating company. suitespot is neither the operator of the hotel nor a tour operator. As we exclusively arrange overnight stays, this is not a package holiday (Pauschalreise). If we arrange further travel services such as flights or car hire in future, we will inform you separately before booking about the applicable terms and your rights.
(2) The hotel’s terms apply to the stay, in particular the rate, cancellation and payment conditions (e.g. regarding deposits) displayed at the time of booking and the house rules.
(3) Our intermediation of hotel bookings is free of charge for you. The suitespot Premium membership is a separate, optional offer. For bookings we arrange, we receive a commission from the hotels or hotel groups. This commission is included in the room price and does not increase your price.
§ 3 suitespot account
(1) To book via suitespot, you need a free suitespot account (“Basic”). You must be of legal age and provide true and complete information. Each person may hold only one account.
(2) With the free account, you can use all of suitespot’s services: you can view hotels, rooms and prices, send free booking requests, book through our team with the benefits of the respective rate, manage your bookings and use our service by email, phone, chat and WhatsApp. Only with the suitespot Premium membership can you book hotels online yourself and see the benefits of every hotel already in the search.
(3) Keep your login details secret. If you suspect that someone is misusing your account, please inform us immediately.
(4) You can have your account deleted at any time in the account settings or by email to hotel@suitespot.com. You must first cancel any ongoing Premium membership in accordance with the membership terms. Confirmed bookings remain in place.
(5) We may block or terminate an account if it is misused, in particular in the case of false information, suspected fraud or commercial use contrary to § 9(4). If we suspect misuse, we will first block the account temporarily and give you the opportunity to comment. If the suspicion is cleared up, we will lift the block without undue delay. Independently of this, we may terminate the free account with four weeks’ notice; confirmed bookings remain in place.
§ 4 Hotel offers, prices and benefits
(1) Rates. We arrange the hotel’s flexible daily rate (Best Available Rate) and, in some cases, reduced special prices, for example free nights for longer stays or percentage discounts. Most rates can be cancelled free of charge up to 24 or 48 hours before arrival and are paid at the hotel on check-out. Some rates require a deposit or prepayment, for example on particularly popular dates or in certain cities. The exact conditions are shown with the rate, in the offer and in the booking confirmation.
(2) Prices. The total prices displayed include all regular taxes and fees, usually including resort and service fees. City or tourist taxes and, in individual cases, resort and local fees may be added and are usually payable on site. If taxes or levies are introduced or increased after booking, the hotel may charge them in addition. If the hotel does not invoice in euros, euro prices are only an estimate at the current daily exchange rate: payment is always made in the hotel’s billing currency at the exchange rate on the day of payment, and our offers and booking confirmations state the price in that currency. Depending on the payment method, foreign currency fees may apply. For bookings with children, additional fees may apply or individual room categories may not be available; we will point this out in the offer.
(3) Benefits. For many rates, the hotel grants additional benefits, for example breakfast, a hotel credit, an upgrade, early check-in or late check-out. The benefits that apply are stated in your booking confirmation. The following applies:
- Benefits marked “subject to availability” are allocated by the hotel on arrival. There is no entitlement to them.
- A hotel credit applies once per booked room and stay, unless the booking confirmation states otherwise, and only in the facilities specified by the hotel (e.g. restaurant, bar, spa). It is not paid out in cash, is not credited against room charges, taxes or fees, and expires to the extent that it is not used during the stay.
- Upgrades are decided by the hotel in accordance with its rules. The hotel may exclude certain room and suite categories as well as associated services (e.g. lounge access). There is no entitlement to a specific room category, not even to the next higher one, unless the upgrade is expressly stated as already confirmed in the booking confirmation. The booked room category must be sufficient for all guests (§ 9(1)).
- Benefits apply to the booked rate and cannot be transferred to other rates. They can only be combined with other promotions if this is expressly stated.
- Whether you receive points and status benefits in the hotel group’s loyalty programme for a stay depends on the rules of the loyalty programme. We pass your membership number on to the hotel if you provide it when booking or store it in your suitespot account.
- Taxes, service charges and gratuities that the hotel adds to a benefit (e.g. to an included breakfast in the USA) are not part of the benefit unless the booking confirmation states otherwise.
- Statements such as “benefits worth an average of €500” describe an average across many stays. The actual value depends on the hotel, rate, length of stay and availability.
(4) Benefit guarantee. For all benefits committed in your booking confirmation without the note “subject to availability”, we provide a guarantee: if the hotel does not provide such a benefit, we will refund you the equivalent value. The following applies:
- The equivalent value is the amount stated in the booking confirmation (e.g. for a hotel credit), otherwise the price the hotel regularly charges for the service (e.g. the hotel’s breakfast price), in each case excluding taxes, service charges and gratuities and only to the extent committed (e.g. for the number of people stated in the booking confirmation).
- Please contact us, if possible while you are still staying at the hotel, so that we can first arrange a remedy with the hotel, but no later than 30 days after departure. Supporting documents such as the hotel invoice help us with our review.
- We will refund the equivalent value within 14 days of our review by bank transfer or to the means of payment you specify.
- The guarantee does not apply to the extent that you do not take up a benefit offered or the benefit is not provided for reasons for which you are responsible, for example because you changed the booking to a rate or room without this benefit.
- Benefits marked “subject to availability” are excluded from the guarantee.
§ 5 Booking
(1) Online booking (Premium). You select the hotel, travel dates, room and rate, enter the guests’ details and a credit card as a guarantee (§ 6), and complete the booking using the button “Book and pay”. By doing so, you instruct us to make the booking with the hotel on the conditions displayed, and you submit a binding offer to the hotel.
(2) Booking request (all accounts). You can request a booking via the button “Send free inquiry” or by email, phone, chat or WhatsApp. The request is non-binding and free of charge for you. We check availability, price and benefits and send you an offer stating the price in the hotel’s billing currency, the cancellation and payment conditions and the benefits. A booking is only made once you expressly accept the offer; if you accept it online, you do so via the button “Book and pay”. If the price or benefits change between your request and the booking, we will inform you and will only book with your consent.
(3) Conclusion of the contract with the hotel. The accommodation contract is concluded when the hotel accepts the booking. We then send you the booking confirmation by email (text form) stating the hotel, travel dates, room, rate, price, cancellation and payment conditions and the committed benefits. If the hotel cannot confirm the booking, we will inform you without undue delay.
(4) Please check the booking confirmation immediately and report any errors promptly.
(5) Booking for other people. You can book for other people. The accommodation contract is then concluded between the hotel and the guests; you act as their representative. You must ensure that the guests are aware of the booking conditions, and you warrant that you are authorised to act on behalf of these people. The hotel may charge the credit card you provided in accordance with the rate conditions even if you are not travelling yourself, for example for a deposit, for cancellation charges or in the event of a no-show.
§ 6 Payment and credit card guarantee
(1) You pay for the stay directly to the hotel, usually on check-out. If a rate requires a deposit or prepayment, the hotel charges the card on file in accordance with the rate conditions, depending on the rate at the time of booking or at a later time before arrival. suitespot does not accept payments for hotel stays and does not charge your card itself.
(2) To guarantee the booking, we pass your credit card details on to the hotel in encrypted form. The hotel may verify the card in advance or reserve an amount (pre-authorisation) and charge the card in accordance with the conditions of the rate, for example for a deposit, for cancellation charges or in the event of a no-show.
(3) On arrival, the hotel may require a credit card for incidental charges.
§ 7 Changes, cancellation and no-show
(1) Whether and until when you can change or cancel free of charge depends on the conditions of the booked rate. These are stated in the booking confirmation. Deadlines refer to the hotel’s local time.
(2) You can send us changes and cancellations via your account, by email to hotel@suitespot.com via WhatsApp or via the chat on our website. If the free cancellation period ends in less than 24 hours, you can also cancel by phone on +49 30 75438770 during our service hours. During our service hours (Monday to Friday 8 am to 10 pm, Saturday, Sunday and nationwide public holidays 9 am to 6 pm, German time in each case), we forward your request to the hotel without undue delay and confirm it to you in text form. For a deadline to be met, it is sufficient for the request to reach us in time. Requests received outside our service hours are deemed received at the start of the next service period. This does not apply if your account shows when cancelling that the cancellation is transmitted to the hotel immediately; in that case, the time of sending is decisive. If a deadline ends outside our service hours, please cancel in good time beforehand or, where possible, immediately via your account. If the hotel charges cancellation fees although your cancellation reached us in time, we will reimburse you for these fees.
(3) If you cancel after the free cancellation period has expired or do not arrive, the hotel may charge cancellation fees in accordance with the conditions of the rate and charge the card on file.
(4) If the hotel changes or cancels a booking (e.g. due to overbooking), the hotel is responsible to you. On request, we will help you find an equivalent solution.
§ 8 No right of withdrawal for hotel bookings
There is no statutory right of withdrawal for accommodation contracts with fixed travel dates (§ 312g(2) no. 9 BGB). You can only cancel a booking free of charge in accordance with the cancellation conditions of the rate. Separate instructions on withdrawal apply to the suitespot Premium membership and to gift vouchers.
§ 9 Obligations of guests
(1) Please provide the names of all guests and all other information correctly and completely. Choose a room category that is sufficient for all guests. A possible upgrade is not relevant for this.
(2) You are yourself responsible for complying with passport, visa, entry and health requirements.
(3) Please observe the hotel’s house rules and requirements, for example regarding check-in times, minimum age, pets or deposits.
(4) The rates and benefits are intended exclusively for private travel. It is not permitted to resell or re-broker bookings commercially, or to make our rates and benefits available to travel agencies, travel intermediaries or comparable providers.
§ 10 Information on suitespot as an online intermediation platform
(1) The provider of the accommodation is the respective hotel or its operating company. These are traders. The consumer protection rules of the European Union therefore apply to your contract with the hotel; however, there is no right of withdrawal (§ 8).
(2) Allocation of responsibilities: The hotel provides the accommodation and the committed benefits. suitespot arranges the booking, transmits your details and requests to the hotel and supports you before, during and after the stay.
(3) Ranking of search results: By default, we sort by “Recommended”. We regularly calculate this ranking for each hotel from three main parameters:
- Popularity with suitespot guests: booking volume via suitespot in recent months and its current trend;
- Guest satisfaction: the hotel’s public Google rating, weighted by the number of ratings;
- Price level: the price compared with other hotels in the same location, with hotels in the upscale segment slightly favoured.
So that results for countries or regions do not consist of a single city only, we mix hotels from different locations. New hotels without sufficient data receive a starting value. You can also sort the results by price in ascending or descending order. Commissions or other payments from hotels do not influence the ranking. This does not apply to placements expressly labelled “Ad”.
(4) Reviews: We do not display guest reviews in the hotel search or in the booking process. On our editorial hotel and destination pages, we display a suitespot rating for each hotel. It is not a guest review but a value we calculate from the hotel’s Google rating, test reports by our editorial team, awards (e.g. Forbes Travel Guide, Michelin) and popularity with suitespot guests. We do not verify whether the underlying Google ratings come from people who have actually stayed at the hotel. We embed reviews of suitespot itself from Trustpilot; Trustpilot explains on its website how it verifies reviews.
§ 11 Liability
(1) We are liable for careful intermediation, in particular for the correct transmission of your booking and your details to the hotel and for correctly passing on the information we receive from the hotel. The hotel is responsible for the stay itself and for the hotel’s services; we are not liable for these. Our benefit guarantee (§ 4(4)) and the reimbursement of cancellation fees (§ 7(2)) remain unaffected.
(2) Otherwise, we are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz) and to the extent of any guarantee we have given. In cases of slight negligence, we are only liable for breach of an essential contractual obligation, and only up to the foreseeable damage typical for this type of contract.
§ 12 Customer service and dispute resolution
(1) Please send questions and complaints to hotel@suitespot.com, by phone to +49 30 75438770 via WhatsApp to +49 30 81452346 or via the chat on our website. Please report complaints about your stay to the hotel and to us while still on site if possible, so that the issue can be remedied.
(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 13 Data protection
For the booking, we pass the necessary data on to the hotel, in particular the guests’ names, contact details, travel dates, credit card details for the guarantee, loyalty programme numbers and your requests. If the hotel is located outside the EU or EEA, we transfer this data to the country concerned. If there is no adequacy decision of the EU Commission for that country, we base the transfer on the fact that it is necessary to perform your booking (Art. 49(1)(b) GDPR). Details can be found in our privacy policy: https://suitespot.com/privacy-policy
§ 14 Changes to these terms
Bookings that have already been confirmed remain subject to the terms that applied at the time of booking. We will notify you of changes relating to the account at least six weeks in advance in text form (e.g. email). If you do not agree, you can have your account deleted free of charge before the changes take effect. New bookings are subject to the version current at the time of booking.
§ 15 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with your habitual residence in another country, the protection afforded by the mandatory provisions of that country remains unaffected. The accommodation contract is governed by the law agreed with the hotel or otherwise applicable by law.
(2) If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the place of jurisdiction is Berlin.
(3) Should any provision of these terms be invalid, the remaining provisions shall remain valid.
